JusticeFast has the overarching aim of fairly and quickly restoring offenders to the community and the community to the offenders. For those who pose no threat to the safety of the community when sober, it punishes the community to incarcerate the offender beyond what is necessary. It is also a violation of the Indiana Constitution for punishment to be vindictive.

How it works:
The judge orders the offender to participate by reporting twice a day for breath or saliva testing and paying a dollar for each test. This order can be a part of the release on own recognizance order after arrest or the order may be made as a part of other orders such as a probation order.
Defendant reports and is tested same time every day, morning and night. North and South Dakota are using 7 am and 7pm as the mandatory times. No time changes are permitted.
Offender reports, signs in and submits to test. If no alcohol is detected, offender leaves. The entire process takes less than five minutes. If alcohol is detected, then offender is taken into custody and tested for drugs. This is immediate and on the spot.
Offender then appears before a judge within 24 to 48 hours and new conditions of release may be fashioned or offender may be held.
There is research literature to support this.
